The Court of Appeal upheld the application judge's finding that Country Pork's building permit application had not crystallized before passage of the interim control by-law and dismissed the building permit appeal; however, because the application judge had not exercised the requisite discretion to decide whether to assume jurisdiction over the challenge to the interim control by-law (an area primarily for the OMB), the Court allowed the appeal on that branch, set aside the order dismissing the application regarding the by-law, and remitted the matter to the application judge to determine in the first instance whether to assume jurisdiction or defer to the OMB.
