On the balance of probabilities the Court found the evidence (police surveillance, two searches recovering drugs and paraphernalia, prior convictions, secreted cocaine in 2009 search, patterns of short visits, congregation of 'Society Rejects' and community complaints) established a reasonable inference that the property was being habitually used for possession, use and sale of controlled substances and that the community was adversely affected; accordingly a Community Safety Order was warranted and the property was ordered vacated and closed for a limited period to protect community safety.
