Ratio Decidendi

In the absence of a statutory prohibition and given the text of the OAS Act and Regulations allowing an estate to apply after death and permitting an approval to be effective as of a date specified in writing, the Tribunal held an estate may request and the Minister must effect a change to the effective date of approval within the statutory retroactivity window; therefore the Minister must change the effective date to October 8, 2020 and payments start November 2020.
