The Tribunal found on the balance of probabilities that public disclosure of the Assessment Documents would cause undue hardship to Transport Canada and pose a serious risk to the public interest in the integrity of hiring; no reasonable alternatives (redaction or other measures) would prevent that risk; accordingly a confidentiality order under s.52(1)(c) CHRA, informed by the Sherman Estate test, was granted for the Assessment Documents. The Tribunal also granted an order under the Privacy Act to permit disclosure of Candidate Information to the parties but refused to extend confidentiality to the Candidate Information absent sufficient justification.
