The adjudicator's decision was quashed because he applied an erroneous and overly expansive test for federal jurisdiction, failed to evaluate CGL's normal or habitual activities (functional test) and whether provincial regulation would impair the federal core, and on the correct analysis CGL is not a federal undertaking and Dawson's duties were not vital, essential or integral to the military; therefore provincial jurisdiction applied and the adjudicator erred in asserting Canada Labour Code jurisdiction.
