[2] On September 6, 2022, the appellants appealed the decision to the Refugee Appeal Division (RAD). [3] The record shows that the appellants fall under the exception at paragraph 110(2)(d) of the Immigration and Refugee Protection Act1 (the Act) pursuant to section 159.5 of the Immigration and Refugee Protection Regulations2 (the Regulations). [4] The appellants were able to make a refugee protection claim before the RPD because they fell under one of the exceptions in section 159.5 of the Regulations. However, paragraph 110(2)(d) of the Act states that an RPD decision in respect of such a claim may not be appealed to the RAD. [5] Accordingly, the RAD does not have jurisdiction to hear the appeal against the decision regarding these appellants.
