Procedural Posture

Civil / Appeal to Court of Appeal From Application Judge (superior Court of Justice)

  1. 1 Whether the Diocesan Administrative Board validly replaced the elected Executive Board with a Temporary Trusteeship under ROLA and the Diocesan Statute
  2. 2 Whether the elected trustees or the Temporary Trusteeship hold and manage the Congregation's property held under ROLA
  3. 3 Whether individual congregation members hold beneficial ownership or an enforceable equitable interest in the property

Ratio Decidendi

The application judge correctly construed the deeds, ROLA, the Diocesan Statute and the Congregation's Bylaws and found that under ROLA s.3(2) and the Statute the Diocesan authorities validly appointed a Temporary Trusteeship which directs the trustees; there was no breach of provincial law and no enforceable individual beneficial ownership that would justify displacing the Temporary Trusteeship, therefore the appellants' declarations and relief were properly refused.
