The wife failed to establish grounds for annulment of the bankruptcy order as the husband was commercially insolvent at the time and the bankruptcy was not tactical. The argument that home rights under s.33 Family Law Act 1996 put the property beyond the reach of the trustee was rejected. The district judge's financial order was not wrong in law or approach, and subsequent events did not meet the Barder criteria for setting aside the order. The trustee is entitled to his fees and expenses.
