Cardiorentis AG v Iqvia Ltd & Anor [2022] EWHC 250 (Comm) (10 February 2022)
The court found that while there were some protocol deviations and eligibility errors in the TRUE-AHF trial, Cardiorentis failed to prove that these were caused by breaches of contract by IQVIA or that they rendered the study unreliable or of no value. The claim for wasted costs therefore failed. IQVIA was entitled to recover unpaid fees under the contract, subject to any set-off for minor breaches not causative of loss.
