Merelie v Newcastle Primary Care Trust [2006] EWHC 1433 (QB) (20 June 2006)
The Trust did not breach the implied term of trust and confidence or act negligently; the disciplinary and grievance procedures were conducted reasonably and in good faith. The conduct of the Defendants did not amount to harassment under the Protection from Harassment Act 1997. The letter from Mr. Smith was protected by qualified privilege and, in any event, the pleaded meaning was not established as defamatory. The claims for psychiatric injury were struck out for lack of causation evidence. All claims were dismissed.
