Miss Hyett became entitled to an immediate and absolute beneficial interest in half the farm by way of constructive trust upon entering into joint liability for the mortgage in 1992. There was no evidence of a common intention that her interest would be defeated on Mr Freeman's death. However, she was not entitled to the proceeds of the RSA policy beyond the surplus after the mortgage was discharged, as the policy was intended to pay off the mortgage.
