Spreadex Ltd. v Battu [2005] EWCA Civ 855 (11 July 2005)
The Court held that under the proper construction of Spreadex's terms, the operator was entitled to security or margin (less the amount of the credit limit) to cover either the running losses or the trading limit, but not both cumulatively. The entitlement was to the higher of the two figures, not their sum. The contractual language, particularly in Rule 6 and Rule 8, did not support Spreadex's case for cumulative security. Therefore, Spreadex was not entitled to close Dr Battu's trades for failure to provide additional margin beyond the higher of the trading limit or running losses.
