Where a claim under the Protocol is started by an individual who subsequently dies, and the claim is settled by the personal representative without proceedings, the costs and disbursements are to be assessed under Section II of Part 45 CPR, not Section IIIA, because the executor is not the person who started the claim under the Protocol and is expressly excluded by the Protocol from doing so.
