ED & F Man Capital Markets Ltd v Come Harvest Holdings Ltd & Ors [2022] EWHC 229 (Comm) (16 February 2022 )
The court found that the claimant was the victim of a large-scale fraud perpetrated by the first to fourth defendants, who knowingly provided forged warehouse receipts to obtain finance. Straits (tenth defendant) was found to have actual knowledge of the fraud and to have participated in an unlawful means conspiracy with Mr Kao and others. The claimant was entitled to rescind the contracts, recover its losses, and equitable proprietary and knowing receipt claims succeeded against relevant defendants. The court rejected the defences of lack of knowledge and good faith.
