The court refused to enforce the cross-undertaking in damages. Although the freezing order was discharged by consent, the court found that, considering all the circumstances—including the substantive merits of Lewis's claim, the risk of dissipation of assets by Eliades, and Eliades's dishonest conduct—there were special circumstances making it inequitable to enforce the undertaking. The court held that Eliades's conduct, including misleading evidence and asset concealment, justified refusal to award damages under the cross-undertaking.
