Ipswich Borough Council erred in law by applying the Referral Guidelines too rigidly, failing to consider the applicant's individual family circumstances and the impact of his refugee background, and not providing adequate reasons for exercising its discretion to refer the applicant to Portsmouth. The review decision was therefore flawed and could not stand.
