Park v Cho & Anor [2008] EWHC 866 (QB) (23 April 2008)
The Election Committee breached the implied contractual obligation to conduct a fair and neutral election by including a candidate as a committee member, extending absentee voting in a manner favouring one candidate, actively soliciting votes for that candidate, and inadequately investigating allegations of impropriety. The failure to properly confirm the election result at the AGM further rendered the process incomplete. These breaches entitled the claimant to a declaration that the election was not conducted in accordance with the Society's constitution and contractual obligations.
