Kaupthing Singer and Friedlander Ltd, Re [2010] EWCA Civ 518 (11 May 2010)
The discounting mechanism in IR 2.105 applies only for the purpose of calculating the set-off and the amount of any dividend to be paid to the creditor. It does not apply to the balance of a future debt owed by the creditor to the company after set-off. The balance that remains due to the company after set-off is the undiscounted contractual amount, payable at the contractual repayment date. This interpretation aligns with the objectives of insolvency administration and avoids an irrational and detrimental outcome for the general body of creditors.
