Ratio Decidendi

The statutory process under section 41A(10) Medical Act 1983 is the appropriate remedy, and judicial review is not available except in exceptional circumstances. The Trust cannot lawfully consider dismissal of Dr George solely on the ground of interim suspension, as section 47(3) Medical Act 1983 preserves employment during suspension.
