Ratio Decidendi

The Court of Appeal held that the High Court judge had no jurisdiction, either under section 36 of the Administration of Justice Act 1970 or under the court's general case management powers, to grant a stay of execution of the possession order pending the outcome of unrelated litigation (Lloyd's v Jaffray) to which the mortgagee was not a party. The only jurisdiction to stay execution was under section 36, which was not satisfied as the mortgagor was not likely to be able to pay the sums due within a reasonable period. The judge's decision to grant the stay was therefore wrong in law and on the facts.
