There was evidential support for the Judge's finding that the local authority negligently returned the claimant to his parents in November 1977 without a proper welfare review, and that this caused him to remain in a harmful environment. However, the claimant had constructive knowledge of the relevant facts before 2004 and thus the claim is time-barred unless a discretionary extension under s 33 Limitation Act 1980 is granted.
