The patent is invalid as it was anticipated by the supply of the Freebit H1 type A/B units in Norway before the priority date. The claims as granted add matter. The patent does not cover an ear unit which is not pre-shaped with the required curves before insertion into the ear. The proposed amendment would be allowable and would avoid anticipation by Smith but would be obvious over Smith and would not avoid anticipation by the Freebit H1 units. The Bose ear units do not infringe.
