The Announcement of October 1994 was not effective to equalise the Normal Retiring Dates for male and female Members under the Scheme because (1) the effect described in the Announcement was not within the power of determination in the definition of NRD in Rule 3, which is limited to particular cases, and (2) the Announcement was not a determination by the Employers as required, nor did it comply with the formal requirements of Rule 41 for altering the Rules.
