Leeman v Mohammed [2001] EWCA Civ 198 (16 January 2001)
Mr Mohammed was not in actual occupation of the flat on 8th July 1999; therefore, his equitable interest was not overriding and was postponed to Mr Leeman's legal estate under the 21-year lease. The fresh evidence on actual occupation was available at trial and lacked sufficient credibility or impact to justify a new trial. The lease to Mr Leeman was valid and conferred a legal estate with priority.
