For public liability insurance, 'bodily injury' occurs when actionable injury arises (i.e., when the disease manifests or is diagnosed), not at the time of exposure. Therefore, the insurer on risk at the time of disease manifestation (MMI) is liable. Late notification to CU was a condition precedent to liability and was not waived by election, so CU is not liable. There is no contribution between insurers as only MMI is liable.
