A tenancy originally granted for mixed business and residential use is not 'let as a separate dwelling' within the meaning of section 1 of the Rent Act 1977, and the unilateral cessation of business use by the tenant does not entitle the tenant to protection under the Rent Act 1977. The character of the letting did not change so as to bring it within the Act, as there was no affirmative assent by the landlord to a change of use.
