Section 12B of the 1987 Act does not apply to a surrender of a lease; the correct procedure for tenants is to serve a section 12C notice to compel the grant of a new lease equivalent to the surrendered lease. The court has no power to order transfer of the 2000 Lease or grant of a new lease in the terms of the surrendered lease where the statutory requirements have not been met and the relevant notice has not been served.
