JSC BTA Bank v Ablyazov [2013] EWHC 3691 (Ch) (26 November 2013)
The court found that Mr Ablyazov was the ultimate beneficial owner and controller of the BVI Defendants, that the AAA Investments were transferred without consideration, and that the Bank suffered loss as a result. The findings of fact from previous proceedings created an issue estoppel, and the defences advanced by Mr Ablyazov were inherently implausible, unsupported by evidence, and contradicted by contemporaneous documents. There was no real prospect of successfully defending the claim, and no compelling reason for a trial. Summary judgment was therefore appropriate.
