British Telecommunications Plc v The Office of Communications [2009] EWCA Civ 1360 (15 December 2009)
The Court held that Universal Service Condition 7 (USC 7) is valid under EU law and the Communications Act 2003. The imposition of USC 7 on BT as a designated universal service provider is within the powers conferred by the Universal Service Directive and the 2003 Regulations, as it is a proportionate and objectively justifiable means of ensuring the provision of comprehensive directory enquiry services to end-users. The regulatory authority has discretion to determine the most efficient and appropriate approach to guarantee universal service, including imposing wholesale obligations on BT. The Tribunal was correct to reject OFCOM's findings of invalidity and to uphold the legality of USC 7.
