Legal Issues
- 1 Whether the threshold criteria under section 31(2) Children Act 1989 are met for making Care Orders for both children.
- 2 Whether long-term foster care is in the best interests of the children given the parents' learning disabilities and the children's needs.
- 3 Whether the proposed interference with family life is necessary and proportionate under Article 8 ECHR.
Ratio Decidendi
The threshold criteria under section 31(2) Children Act 1989 are met due to significant harm suffered and likely to be suffered by both children as a result of neglect, emotional and physical harm in the parents' care, attributable to the parents' learning disabilities and inability to meet the children's needs even with support. The welfare of both children requires Care Orders with long-term foster care in separate placements, as no other realistic family placement is available and the children have thrived in their current placements. The interference with family life is necessary and proportionate under Article 8 ECHR, given the risks and the lack of any less interventionist alternative.
Court Disposition
Care Orders made for both children with plan for long-term foster care in separate placements; contact arrangements approved.
Orders
- Care Order for 'O' (9 years old)
- Care Order for 'Y' (7 years old)
