The recorder set the bar too high in assessing whether there had been a sufficient change of circumstances, failed to properly evaluate the mother’s progress in light of expert evidence, and did not adequately consider the children’s relationship with the mother or the proportionality of adoption. The mother’s abstinence, engagement with therapy, and other positive changes, when viewed in context, amounted to a sufficient change of circumstances to warrant leave to apply. Her prospects of success were more than fanciful, and it was in the children’s interests for the application to proceed.
