The judge was entitled to find that the relevant payments were not genuine commercial transactions but mechanisms to benefit Mr Aydin at Goldtrail's expense. The only reduction in liability was for the £500,000 advance payment that was recouped by Goldtrail before insolvency, for which no compensation was due.
