Procedural Posture

Commercial Insurance Claim / High Court Judgment

  1. 1 Are the Remediation Payments made by SLAL covered as 'Mitigation Costs' under the professional indemnity policy?
  2. 2 Does Clause 18(iii) exclude coverage for the payments?
  3. 3 Is the deductible properly applied and how should aggregation be determined?

Ratio Decidendi

The court held that the Remediation Payments made by SLAL, including the Cash Injection, were not incurred solely for the purpose of avoiding or reducing third party claims covered by the policy, but were primarily made to protect SLAL's brand and reputation. As such, they do not qualify as 'Mitigation Costs' under the policy. Furthermore, Clause 18(iii) excludes coverage for liabilities arising from failures to apply fair valuation to portfolio securities. The claim was therefore dismissed.
