The court found that the claimants, through the conduct of Ms Oriel in her press briefing and other communications, breached the implied term of trust and confidence, amounting to a repudiatory breach of contract. The defendant was entitled to treat himself as constructively dismissed. On the proper construction of the SPA, constructive dismissal is not a voluntary unilateral resignation, so the restrictive covenant is reduced from three years to two years.
