The Court of Appeal held that while there is a formal jurisdiction to vary undertakings in a consent order, the scope for exercising this jurisdiction is extremely limited, particularly where the variation would fundamentally alter the basis of the original order. The proposed variation would undermine the finality of the consent order, and there was no basis to exercise the jurisdiction to vary the undertaking in this case. The appeal was therefore dismissed.
