Procedural Posture

Libel and Breach of Contract / Assessment of Damages Following Summary Judgment

  1. 1 What is the appropriate measure of damages for a corporate claimant in a libel action under s.8 of the Defamation Act 1996?
  2. 2 Does subsequent corporate restructuring affect the assessment of damages for libel?
  3. 3 Should damages for breach of contract be awarded in addition to libel damages for the same publication?

Ratio Decidendi

Damages for libel against a corporation are to be assessed based on the seriousness of the allegation, the extent of publication, and the relationship of the publishees to the claimant. The presumption of damage applies, and the cap under s.8 of the Defamation Act 1996 limits the award to £10,000. Subsequent restructuring does not negate the damage suffered prior to that event.

Court Disposition

Damages for libel assessed at £10,000; damages for breach of contract assessed at £10.

Orders

  • Defendant to pay £10,000 to claimant for libel under s.8 Defamation Act 1996.
  • Defendant to pay £10 to claimant for breach of contract.
