London Allied Holdings Ltd. v Lee & Ors

London Allied Holdings Ltd. v Lee & Ors

The £1 million was paid by LAH to Mr Lee as a result of fraudulent misrepresentations made by Mr Lee and Mr Dolan regarding the purported sale of the Ritz Hotel. The representations were knowingly false and intended to induce LAH to make the payment. Mr Lee and Mr Dolan were partners or acted as each other's agents in the fraud. The payment is voidable for fraud, and LAH is entitled to rescind the transaction, trace the funds, and assert a constructive trust over the proceeds and assets acquired with the money. Damages are also recoverable for deceit and conspiracy to defraud, subject to the proprietary claims.
