Ratio Decidendi

The Employment Tribunal does not have the power to impose an indefinite stay on proceedings for the purpose of compelling claimants to pursue their equal pay claims in the High Court. The statutory scheme provides for transfer from the High Court to the Tribunal, but not the reverse. The Tribunal's general case management powers cannot be used to override the statutory right to have claims heard in the Tribunal. Even if such a power existed, it would not be appropriate to exercise it in this case, as the Tribunal is the specialist forum for such claims and is equipped to handle complex equal pay litigation.
