The statutory assumptions under the Drug Trafficking Act 1994 apply to the calculation of benefit for a convicted drug trafficker, even if the defendant was acquitted on a related count covering a longer period, unless the defendant can show on the balance of probabilities that the assets were not the proceeds of drug trafficking or that applying the assumptions would create a serious risk of injustice. Mere acquittal on a count does not suffice to disapply the assumptions.
