Coromin Ltd v AXA Re & Ors
The Motor is a discrete item of machinery for the purposes of the EMB Extension. All four EMB Extension conditions were satisfied for both the Motor and the Mill before policy inception. 'Official acceptance' does not require 'Definitive Acceptance' but is satisfied by Provisional Acceptance and formal handover. Business interruption losses relating to the Molybdenum Plant are recoverable as the policy covers all operations and activities of the insured, regardless of whether the business existed at the time of the incident.
