Service of the notice of arbitration was not effected on Baffin or an agent with actual or ostensible authority within the time bar; however, the conduct of Baffin’s agent (the Club) in the 11th March conversation, by failing to clarify lack of authority when asked, contributed to the claimants’ failure to serve in time and made it unjust to enforce the time bar. Accordingly, an extension of time under s.12(3)(b) of the Arbitration Act 1996 was granted.
