Where a defendant has had early notice of a claim, liability is admitted, and the delay in issuing proceedings is short, the accrual of a limitation defence is a windfall and its loss does not constitute real prejudice. Section 33 discretion should be exercised to allow the action to proceed unless the defendant can show forensic prejudice caused by the delay.
