The defendant is the successful party, having defeated the claimants' claims both on law and fact, and is entitled to its costs. The claimants' conduct from October 2010 onwards was unreasonable to a high degree, justifying indemnity costs from that date. No extension of time to appeal is granted due to claimants' failure to act on prior notice. No reduction or issue-based apportionment of costs is warranted as the defendant's conduct did not affect litigation costs and the failed statutory authority defence was relevant to the successful reasonable user defence.
