The solicitor's equitable lien applies where a solicitor provides services, within the scope of a retainer, in relation to the making of a client's claim (with or without legal proceedings), which significantly contribute to the successful recovery of a fund by the client. The existence of an actual or reasonably anticipated dispute is not required. The lien does not extend to purely transactional work. Bott & Co's services in flight delay compensation claims satisfy this test, and the appeal is allowed.
