Article 6 ECHR was not engaged because the effect of the disciplinary proceedings was not to deprive the claimant of the right to practise his profession as a doctor; he remained able to practise, including in the private sector, and was not subject to an alert letter or barred list. The disciplinary and appeal panels, as constituted, were not in breach of Article 6, and even if Article 6 had been engaged, the procedures were sufficiently independent and impartial. There was no waiver of Article 6 rights, and no requirement to give reasons for panel composition under the agreed procedures.
