The 2000 Lease was executed by Astim and GAHL in late July/early August 2000 and deliberately backdated. However, the backdating did not render the lease void as a matter of law, as the date was immaterial to the substantive rights and there was no authority requiring avoidance in these circumstances. The lease was not a nullity for forgery. The alternative claim that the lease was granted in breach of fiduciary duty failed because the evidence did not establish that GAHL or Mr Wagner were complicit in any breach or acted otherwise than bona fide. Astim was not entitled to possession or mesne profits.
