The Employment Tribunal was entitled to take into account the consequential effects of the discriminatory act, including the disciplinary investigation, health effects, transfer, and delay in grievance resolution, in assessing damages for injury to feelings. The employer's failure to sanction the transgressor and his promotion during the unresolved investigation constituted aggravating conduct justifying an award of aggravated damages. The awards were not excessive or irrational, and the tribunal's reasoning was sufficient.
