Ratio Decidendi

The court held that it was bound by the decision in R v Tivnan, which established that section 16(2) of the Drug Trafficking Act 1994 applies to after-acquired assets. In the absence of realistic proposals from the respondent and given the policy of the legislation, a receiver should be appointed over the respondent's beneficial interest in the properties. However, enforcement of sale is suspended to allow the respondent time to seek leave to appeal.
