The defendants' decisions not to inform the parents prior to removal and to remove the children were reasonable, necessary, and proportionate responses to the perceived risk, supported by multidisciplinary evidence and guidance on FII. The actions did not breach the claimants' rights under Article 8 or amount to negligence. The police arrests and detention of the parents were lawful and necessary for effective investigation and child protection. Even if there had been any breach, the children would have been removed by court order in any event, so no material loss resulted (Lumba principle).
