The Court of Appeal held that neither the ongoing detailed assessment below nor the uplift on counsel's fees justified departing from summary assessment. The base costs claimed were disproportionate given the value and significance of the dispute, so only necessarily incurred and reasonable costs were allowed. The uplift (success fee) was reduced to 50% as 100% was excessive given the prospects of success.
